Regulations of the ESMEFORDOG.PL Online Store

§1 General provisions

The online store available at www.esmefordog.pl is run by Wojciech Gac running a business under the name ESMEFORDOG Wojciech Gac with its registered office at ul. Sowia 7, 43-332 Pisarzowice, NIP: 5471636409, REGON: 070740828, telephone: +48 608105400, e-mail address: hello@esmefordog.pl.

The store conducts retail sales via the website mentioned above. The sale is conducted on the basis of these regulations, taking into account generally applicable laws. The prices given in the store are expressed in the Polish currency (PLN) and are gross prices (including VAT). Product prices do not include the cost of delivery.

§2 Definitions

Whenever the following terms are used in these Regulations, they should be understood as:

  1. Contact details - ESMEFORDOG Wojciech Gac with its registered office at ul. Sowia 7, 43-332 Pisarzowice
  2. Price - it should be understood as expressed in the Polish currency (PLN) and includes VAT (gross amount). Product prices do not include the cost of delivery.
  3. Customer - it should be understood as a natural person, private person or organizational unit making purchases in the ESMEFORDOG Online Store not directly related to his business or professional activity.
  4. ESMEFORDOG - it ought to be understood as the Online Store located at the electronic address www.esmefordog.pl, run and owned by the Seller.
  5. Seller - ESMEFORDOG Wojciech Gac with its office at ul. Sowia 7, 43-332 Pisarzowice, NIP: 5471636409, REGON: 070740828, telephone: +48 608105400, e-mail address: hello@esmefordog.pl.
  6. Parties - it ought to be understood as the Seller and the Customer.
  7. Personal data - it ought to be understood as a set of personal data of the Customer, processed by the Seller in order to fulfill the order.
  8. Deliveries - it ought to be understood as the type of transport service along with the specification of the carrier (courier company) and its cost.
  9. Delivery costs - it ought to be understood as fees for the delivery of the Product to the Customer specified in the FAQ on the subpage of each of the products offered by the Seller.
  10. Product - it ought to be understood as the range offered by the Seller for retail sale in the ESMEFORDOG Online Store.
  11. Promotion - it ought to be understood as a short-term reduction of the Price on the Goods selected by the Seller, located in the ESMEFORDOG Online Store
  12. Basket - it ought to be understood as the electronic order form provided by the Seller on the ESMEFORDOG online store website, through which the Customer purchases the Goods.
  13. Payments - it ought to be understood as the act of paying, in the manner specified in these Regulations, the indicated price of the Goods and the costs of delivery.
  14. Order processing - it ought to be understood as actions taken by the Seller to deliver the ordered Goods to the address indicated by the Customer.
  15. Order - it ought to be understood as a legal act performed using the Cart, during which the Customer expresses a desire to purchase selected Goods in accordance with their description and Price.
  16. Agreement - it ought to be understood as the Agreement for the sale of the Goods offered by the Seller, concluded without the simultaneous presence of the Parties using the telecommunications network.
  17. Proof of purchase - it ought to be understood as confirmation of the conclusion of the Agreement between the Seller and the Customer, e.g. in the form of a bill, invoice or payment confirmation.

§3 Orders

  1. Orders in the Store can be placed in the following way:
    1. via the Order form available on the Store's website,
    2. by e-mail to the address provided on the Store's website,
    3. via a private message sent on a fan page on Facebook (https://www.facebook.com/esmefordog/).
  2. Orders can be placed 24 hours a day, 7 days a week.
  3. The Parties are bound by the information contained on the Store's website next to the purchased goods at the time of placing the Order, in particular: Price, Product characteristics, its features, elements included in the set, date and method of Delivery.
  4. When placing an order, the Customer indicates:
    1. your personal data to the extent necessary to perform the order,
    2. ordered product,
    3. postal address to which the ordered product is to be delivered,
    4. delivery method,
    5. payment method.
  5. The conclusion of the contract with the Customer takes place upon the acceptance of the Order by the Seller, of which he informs the Customer within 48 hours of placing the order by e-mail.
  6. The contract is concluded in Polish, in accordance with Polish law and these regulations.
  7. In the case of prepayment, the order is accepted for processing after the Store receives confirmation of payment.
  8. The conclusion of the contract with the Customer takes place at the time of placing the Order.
  9. The execution of the Customer's order payable by bank transfer or via the electronic payment system takes place after the Customer's payment is credited to the Seller's account.
  10. The Customer is obliged to pay the Price under the Sales Agreement within 7 business days from the date of its conclusion, unless the sales agreement provides otherwise. Failure to pay the Customer in due time shall mean the cancellation of the Order.
  11. Placing an Order and its confirmation by the Customer in the manner indicated in paragraph 4 is a legally binding Sales Agreement concluded between the Online Store and the Customer.
  12. Shipments are sent up to 1 to 5 business days from recieving the receipt of the payment / payment. The customer is informed about sending the package by a separate e-mail, which is generated automatically after placing the order. In special cases, the Seller reserves the right to complete the order within 14 working days from the time the funds are credited to the account or when the ordered products are completed. However, the customer will be informed about it by phone or e-mail.

§4 Payments

  1. The customer can choose from the following payment methods:
    1. Transfer to a company account.
    2. Cash on delivery
    3. Online Payments:

§5 Product shipment

  1. The ordered Product is sent by the Store via courier or InPost.
  2. The ordered Products are delivered in accordance with the Regulations of the courier company or InPost.
  3. In the case of payment by bank transfer or using a payment card, the deadline for delivery of the Product is counted from the date the payment is credited to the Seller's bank account.

§6 Complaints and returns

  1. In the event of non-compliance of the Product with the contract, the Customer is obliged to immediately contact the Seller by sending an e-mail to the following address: hello@esmefordog.pl along with a description of the Product complained about and its non-compliance with the Agreement.
  2. The Store considers the Customer's complaint within 14 days from the moment of returning the Product together with a description of the non-compliance.
  3. If the complaint is accepted, the Delivery costs are borne by the Store.
  4. The product covered by the promotion or from the sale is not returnable.

§7 Withdrawal from the agreement

  1. The Customer has the right to withdraw from the Agreement without giving any reason within 14 days of receiving the Product, unless it has traces of use.
  2. The Customer returns the Product to the Online Store within 14 days of submitting the declaration of withdrawal from the Agreement.
  3. The Customer returns the Product that is the subject of the Agreement from which he withdrew at his own expense and responsibility.
  4. Within 3 business days of receiving the parcel, the Online Store will check the condition of the delivered Product.
  5. Within 14 days of submitting the declaration of withdrawal from the Agreement, the Seller shall refund the amount paid to the Customer. The refund will be made by transfer to the bank account from which the payment was made or the account indicated by the Customer in the withdrawal form.
  6. The right to withdraw from the Agreement is not entitled to the Customer if the subject of the Sales Agreement are non-prefabricated items, manufactured according to the customer's specifications or to meet his individual needs.

§8 Warranty

  1. The warranty period begins on the date of purchase of the product and is 1 year.
  2. The warranty is valid on the territory of Poland.
  3. The warranty covers manufacturing and material defects of the product.
  4. The warranty does not cover any claims other than those mentioned in point 3, and in particular: product defects caused by improper use or misuse, improper maintenance, product modification, improper storage, destructive dirt, e.g.
    1. oils,
    2. paints,
    3. solvents,
    4. acids,
    5. mechanical damage; consumption of materials as a result of normal use, caused by events such as:
  • fire,
  • moisture,
  • crushing,
  • tearing,
  • slits,
  • bites, etc.

The warranty is valid only with the Proof of purchase of the Product, which has a legible date of purchase and the Seller's labeling. The warranty does not exclude, limit or suspend the rights of the buyer resulting from the non-compliance of the goods with the contract and the Act on consumer rights. The guarantee does not cover claims arising from the recovery of losses or lost profits as a result of the resulting defect, even covered by the guarantee. The Distributor bears no responsibility for the suitability of the Product for specific purposes and for the consequences of their choice and use. The warranty is discontinued in the event of the earlier defect mentioned in point 4 or / and repairs carried out at a non-authorized service point. After verification of the defect at the Seller's premises, the Product will be repaired or replaced with a new one; if the same Product is unavailable, it will be replaced with a similar one, or the Customer will be refunded.

§9 Privacy protection

  1. The administrator of the Customer's personal data is ESMEFORDOG Wojciech Gac with its registered office at ul. Sowia 7, 43-332 Pisarzowice, NIP: 5471636409, REGON: 070740828.
  2. Personal data provided by the Customer on the esmefordog.pl website are processed for the purposes of implementing the Sales Agreement and, with separate consent, may be processed for marketing and promotional purposes, in accordance with the conditions set out in the Act of August 29, 1997 on the protection of personal data (Journal U. No. 101 of 2002, item 926, as amended).
  3. Providing Personal Data by the Customer is voluntary, yet necessary for the implementation of the Sales Agreement.
  4. The customer has the right to access their data and correct them, request the cessation of their processing, object to their processing and request their removal.
  5. The customer may receive by e-mail, in particular to the e-mail address provided by the customer, marketing or promotional materials, if he agrees.
  6. The customer may at any time withdraw consent to receive marketing or promotional materials sent electronically by sending information about the cancellation to the following e-mail address: hello@esmefordog.pl

§10 Intellectual property

  1. All names of goods offered for sale by the Seller, their descriptions and photos are used for identification purposes and may be legally protected or reserved.
  2. By providing the Store with photos containing products purchased in the ESMEFORDOG Online Store, the Customer declares that he has all copyrights to it and automatically agrees to the publication of the photo on the Store's website and on the Store's profile on social networks.

§11 Amendments to the Regulations

  1. The Regulations come into force on the day of publication on the website of the Online Store www.esmefordog.pl
  2. These Regulations may be changed.
  3. Amendments to the Regulations will be published on the Online Store website.
  4. Information about changes to the Regulations will be sent to the Customer to the e-mail address indicated in the Order. Within 14 days from the date of receipt of the message about the amendment to the Regulations, the Customer may submit a declaration of termination of the Agreement.
  5. In the event of failure to terminate the Agreement within the period indicated above, the Customer is bound by the provisions of the amended Regulations.

§12 Protection of personal data

Customers' personal data will be processed by the Seller, as the administrator of personal data, in order to provide services by the Seller, as well as, subject to the consent of the Customer, for marketing purposes related to the functioning of the store. The processing of the collected data is carried out in accordance with the provisions of the Act of August 29, 1997 on the protection of personal data (Journal of Laws No. 101 of 2002, item 926 as amended) and the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, as amended).

§13 Final provisions

In matters not covered by the Regulations, generally applicable provisions of law shall apply, in particular the Civil Code and the Act on specific terms of consumer sales and the amendment to the Civil Code.
